When should I file a personal injury action?

When you are injured by another’s negligence, carelessness, or wrongful conduct, you may be able to seek compensation from the negligent parties and their insurers by filing a personal injury claim.

Why do I need a lawyer?

Imagine this: You have been in an accident that you believe was not your fault. A representative from the at-fault party’s insurance company contacts you and says that with a little cooperation from you, they can offer you a quick settlement to resolve your claim. Stop right there!

When injuries are permanent, serious, or catastrophic, legal representation by experienced counsel is the only way to obtain fair compensation for your injuries. The reputation of your attorney can make a substantial difference in the settlement amount ultimately obtained.

Victims involved in accidents are not merely injured physically. They very often have emotional trauma related to the accident that may impair judgment. It is common sense that the insurance company representing the person or company responsible for your injuries is not your friend.

Attorneys at the Lynn Law Firm prefer to become involved in a potential lawsuit at the very outset to prevent clients from settling too quickly for less than they deserve. Early contact is essential and ensures that all possible sources of recovery remain available to the plaintiff.

How long do I have to make my claim?

For most personal injury cases, there is a two or three year statute of limitations. This means you must file your claim within two or three years of the date of the injury or you lose the opportunity to sue. Some claims, such as those involving government entities, must be filed more quickly with some deadlines as short as 90 days.  This is one of the many areas where legal advice is important. Call the Lynn Law Firm to make sure you do not miss important deadlines.

What kind of financial compensation can I receive?

You may be entitled to money damages for all losses and expenses incurred as a result of your accident. These may include—

  • Medical bills
  • Lost wages
  • Pain and suffering
  • Permanent injuries
  • Physical disfigurement
  • Emotional trauma
  • Physical and occupational rehabilitation
  • Loss of enjoyment
  • Loss of affection
  • Mental disability
  • Property damage
  • Out-of-pocket expenses
