Lynn Law Firm attorneys publish article on homeowners' "dwelling" clauses

The New York Law Journal and PropertyCasualty360 published expert commentary from firm attorneys Martin Lynn and Kelsey Shannon on New York courts' consideration of homeowners so-called "dwelling clauses."  As Kelsey and Martin explained, in courts across New York, homeowners find themselves litigating the most intimate details of their lives — where they sleep, who they live with, how they cook their dinner — all in the name of insurance.  More specifically, in the name of the "residence" or "dwelling" provision in their homeowners' policies, which insurance companies increasingly contend limit the homes eligible for coverage to those homes in which the insured "resides." In this article, we examine how courts have addressed this almost existential question. Kelsey and Martin explain how insurers' unwillingness to settle on a consistent — or even articulable — definition of the term has been a double-edged sword, at once providing for disclaimers over a broad swath of behavior but also planting the seeds of defeat.

Families of pastor, friend killed in Cicero truck crash awarded nearly $4 million

The Syracuse Post-Standard | Syracuse.com reported on a more than $2 million settlement obtained by the Lynn Law Firm for the family of a pastor killed by a tractor-trailer at the Route 31 highway interchange in Cicero, N.Y.  As the newspaper reported, the settlement provided a rare view into the successful settlement of a personal injury lawsuit.  The runaway truck that caused the death was hauling too many pieces of machinery, was going over the 55 mph limit for its special permit and didn't have a working brake system on its trailer.  Perhaps most egregious was that a passing trucker on Interstate 81 had warned the driver that something appeared to be loose on his trailer, but the driver continued going until the Route 31 off-ramp.  

A second Lynn Law Firm client, who survived the horrific crash, received a $175,000 settlement.

Lynn Law Firm defeats Allstate on behalf of homeowner

The Lynn Law Firm won a significant victory on behalf of a homeowner whose house was destroyed by fire.  His insurer had refused to cover the loss, arguing that he was not a "resident" of the home.  The Chemung County Supreme Court agreed with the Lynn Law Firm, however, that Allstate's policy was unacceptably ambiguous, that Allstate had known of the plaintiff's whereabouts, and that Allstate had ratified the contract by accepting payments for 17 months after deciding not to cover the damages.  This high-profile victory has received significant professional and press attention, including in The New York Law Journal and The Insurance Coverage Law Information Center.
